AirSeed takes the protection of your personal information seriously. AirSeed complies with the Privacy Act 1988 (Cth) (Privacy Act) and the Australian Privacy Principles (APPs), the European Union (EU) General Data Protection Regulation (GDPR), and the United States privacy laws, to the extent applicable). This Privacy Policy lets you know what personal information we collect and hold, what we do with it, who we will disclose it to, how you can access the personal information we hold about you, how to change inaccurate personal information and how to opt out of receiving communications from us.

Personal information?

Personal information is any information or an opinion about an identified individual or an individual who can be reasonably identified from the information or opinion. Information or an opinion may be personal information regardless of whether it is true.

What personal information, personal data or personally identifiable information does AirSeed collect, store and process?

AirSeed collects personal information as defined by the APPs, which could include your name and your contact details, such as email, telephone, and address. We may also collect information about how you access, use and interact with the website.

This information may include:

  • the location from which you have come to the site and the pages you have visited; and
  • technical data, which may include IP address, the types of devices you are using to access the website, device attributes, browser type, language and operating system.

How does AirSeed collect personal information?

AirSeed will generally collect your personal information directly from you during the course of business. We may collect personal information about you from third parties. If so, we will inform you as and when practicable of this collection and the circumstances of this collection.

We store personal information in computer systems and databases operated by us or our external service providers. Some information is recorded in hard copy that we store securely. We implement and maintain processes and security measures to protect personal information which we hold from misuse, interference, or loss, and from unauthorised access, modification or disclosure.

These processes and systems include:

  • the use of identity and access management technologies to control access to systems on which information is processed and stored;
  • requiring employees to comply with internal information security policies and keep information secure;

What are the purposes for which AirSeed uses, handles and discloses your personal information?

Our purposes are so that we can:

  • provide you with products and services, and manage our relationship with you;
  • contact you, for example, to respond to your queries or complaints, or if we need to tell you something important;
  • comply with our legal obligations, a court order or subpoena or a request from a law enforcement agency to release information, and assist government and law enforcement agencies or regulators; and
  • identify and tell you about other products or services that we think may be of interest to you.

If you do not provide us with your personal information, we may not be able to provide you with our services, communicate with you or respond to your enquiries.

Who will AirSeed disclose your personal information to and why?

AirSeed will not disclose any personally identifiable information we collect from you unless we have your prior consent. We will otherwise only report the information you provide in an aggregate form that will not personally identify you. We will not disclose any personal information or personally identifiable research information to a third party for a purpose other than conducting our business unless we have your express prior consent or are required to do so by an Australian law or court/tribunal order. We may transfer or disclose personal information to our related companies. If the ownership or control of all or part of our business changes, we may transfer your personal information to the new owner.

We may disclose your personal information to third parties where:

  • we are required or authorised by law to do so;
  • you may have expressly consented to the disclosure or the consent may be reasonably inferred from the circumstances; or
  • we are otherwise permitted to disclose the information under the Privacy Laws.

In the course of conducting our business we may rely on third party service providers to host or store the data we collect who are located overseas, including in the United States. We will take reasonable steps to ensure any service providers (and their employees and contractors) comply with the Privacy Laws and/or are subject to similar privacy laws, and that you have the ability to enforce those rights.

Do we use personal information for marketing?

We use personal information to offer products and services we believe may interest you, but we will not do so if you tell us not to. Where you receive electronic marketing communications from us, you may opt out of receiving further marketing communications by following the opt-out instructions provided in the communication.

Access, Openness and Correction

You have the right to request access to details of personal information that we hold about you in accordance with the Privacy Laws.

You can request this information by contacting our Privacy Officer at the details listed at the end of this Policy. Where we hold information that you are entitled to access, we will respond to your request in a reasonable time and endeavour to provide you with a suitable range of choices as to how access is provided (e.g., emailing or mailing it to you). A fee may be charged to cover the cost of retrieval. However, this fee will not be excessive and will only apply to the facilitation of your request.

If at any time you believe that personal information we hold about you is incorrect, incomplete or inaccurate, then you may request amendment of it and we will either amend the information or make a record of your comment, as we think appropriate.

European Union Privacy Policy: General Data Protection Regulation

This section sets out our commitment to complying with the European Union General Data Protection Regulation (GDPR) to the extent it applies to AirSeed, and to protecting the privacy of personal data provided to us, or otherwise collected by us, offline or online, including through the website. AirSeed will comply with the principles of data protection set out in the GDPR for the purpose of fairness, transparency and lawful data collection and use. What personal data is collected and processed?

AirSeed will only collect personal data with your express consent for a specific purpose and any data collected will be to the extent necessary and not excessive for its purpose. We will keep your personal data safe and secure.

We will process your personal data if it is necessary for our legitimate interests, or to fulfil a contractual or legal obligation. We process your personal data if it is necessary to protect your life or in a medical situation, it is necessary to carry out a public function, a task of public interest or if the function has a clear basis in law. We process your personal data as a processor and/or to the extent that we are a controller as defined in the GDPR. We must establish a lawful basis for processing your personal data. The legal basis for which we collect your personal data depends on the data that we collect and how we use it.

We do not collect or process personal data that is considered "Sensitive Personal Information" under the GDPR, such as personal information relating to your sexual orientation or ethnic origin unless we have obtained explicit consent, or if it is being collected subject to and in accordance with the GDPR. AirSeed may collect Usage Data including information such as your device's Internet Protocol address (i.e. IP address), browser type, browser version, the website pages that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

When you access our website by or through a mobile device, we may collect certain information automatically, including but not limited to the type of mobile device you use, your mobile device unique ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use, unique device identifiers and other diagnostic data. We may also collect information that your browser sends whenever you visit our website or when you access the website by or through a mobile device.

Your rights under the GDPR

If you are an individual residing in the EU, you have certain rights as to how your personal data is obtained and used. Under the GDPR, as a data subject you have the right to:

  • have your data deleted or corrected where it is inaccurate;

Data Subject Rights

We have processes in place to deal with Data Subject Rights requests. Our actions and responsibilities will depend on whether we are the controller or processor of the personal data at issue. Depending on our role as either a controller or processor, the process for enabling Data Subject Rights may differ, and are always subject to applicable law. Although we take measures to safeguard against unauthorised disclosures of information, we cannot assure you that personal information that we collect will not be disclosed in a manner that is inconsistent with this Privacy Policy.

AirSeed will retain your personal data only for as long as is necessary for the purposes set out in this Policy. We will retain and use your personal data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

AirSeed will retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter time period, except when this data is used to strengthen the security or to improve the functionality of our Service, or we are legally obligated to retain this data for longer time periods.

Hosting and Data Transfers

Data that we collect may from time to time be stored, processed or transferred between parties or sites located in countries outside of Australia. Transfers to countries outside of Australia will be protected by appropriate safeguards including the use of standard data protection clauses adopted or approved by the European Commission which you can obtain from the European Commission Website. You acknowledge that personal data that you submit for publication through our website or services may be available via the internet around the world. We cannot prevent the use (or misuse) of such personal data by others.

United States Privacy Policy:

This section sets out our commitment to complying with relevant United States privacy laws to the extent these apply to AirSeed, and to protecting the privacy of Personally Identifiable Information provided to us, or otherwise collected by us, offline or online, including through the website. This section applies to users of the website who visit without transacting business (Visitors) and users who make use of the various services offered by AirSeed (Authorised Customer).

Personally Identifiable Information

Personally Identifiable Information refers to any information that identifies or can be used to identify, contact, or locate the person to whom such information pertains, including, but not limited to, name, address, phone number, fax number, email address, financial profiles, social security number, and credit card information. Personally Identifiable Information does not include information that is collected anonymously (that is, without identification of the individual user) or demographic information not connected to an identified individual.

What organisations are collecting the information?

In addition to our direct collection of information, our third-party service vendors (such as credit card companies, clearing houses and banks) who may provide such services as credit, insurance, and escrow services may collect this information from our Visitors and Authorised Customers. We do not control how these third parties use such information, but we do ask them to disclose how they use personal information provided to them from Visitors and Authorised Customers. Some of these third parties may be intermediaries that act solely as links in the distribution chain, and do not store, retain, or use the information given to them.

How is Personally Identifiable Information used?

We use Personally Identifiable Information to customise the website, to make appropriate service offerings, and to fulfil buying and selling requests on the website. We may email Visitors and Authorised Customers about research or purchase and selling opportunities on the website or information related to the subject matter of the website. Visitors and Authorised Customers may opt out of receiving unsolicited information from or being contacted by us and/or our vendors and affiliated agencies by responding to emails as instructed, or by contacting us.

What partners or service providers have access to Personally Identifiable Information from Visitors and/or Authorised Customers on the website?

AirSeed has entered into and will continue to enter into partnerships and other affiliations with a number of vendors. Such vendors may have access to certain Personally Identifiable Information on a need-to-know basis for evaluating Authorised Customers for service eligibility. Our privacy policy does not cover their collection or use of this information.

How does the website keep Personally Identifiable Information secure?

All AirSeed employees are familiar with our security policy and practices. The Personally Identifiable Information of our Visitors and Authorised Customers is only accessible to a limited number of qualified employees who are given a password in order to gain access to the information. We audit our security systems and processes on a regular basis. Sensitive information, such as credit card numbers or social security numbers, is protected by encryption protocols, in place to protect information sent over the Internet. While we take commercially reasonable measures to maintain a secure website, electronic communications and databases are subject to errors, tampering and break-ins, and we cannot guarantee or warrant that such events will not take place and we will not be liable to Visitors or Authorised Customers for any such occurrences.

How can Visitors correct any inaccuracies in Personally Identifiable Information?

Can a Visitor delete or deactivate Personally Identifiable Information collected by the website?

Visitors and Authorised Customers may contact us to delete or deactivate Personally Identifiable Information about them, by emailing us at the contact details at the end of this Policy. However, because of backups and records of deletions, it may be impossible to delete a Visitor’s entry without retaining some residual information. An individual who requests to have Personally Identifiable Information deactivated will have this information functionally deleted, and we will not sell, transfer, or use Personally Identifiable Information relating to that individual in any way moving forward.

AirSeed Website

When visiting AirSeed’s website, the site server makes a record of the visit and logs the following information for statistical and administrative purposes:

  • the user’s server address – to consider the users who use the site regularly and tailor the site to their interests and requirements;
  • the date and time of the visit to the site – this is important for identifying the website’s busy times and ensuring maintenance on the site is conducted outside these periods;
  • pages accessed and documents downloaded – this indicates to AirSeed which pages or documents are most important to users and also helps identify important information that may be difficult to find;
  • duration of the visit – this indicates to us how interesting and informative the AirSeed website is to candidates;
  • the type of browser used – this is important for browser specific coding; and
  • visitors’ journeys on the site - including heat maps of the content visited

In order to optimise the AirSeed website and better understand it’s usage, we collect the visiting domain name or IP address, Computer Operating System, Browser Type and Screen Resolution.

A cookie is a piece of information that an Internet web site sends to your browser when you access information at that site. Cookies are either stored in memory (session cookies) or placed on your hard disk (persistent cookies). The AirSeed website does not use persistent cookies. Upon closing your browser the session cookie set by this web site is destroyed and no Personal Information is maintained which might identify you should you visit our web site at a later date.

Retention and destruction of Personal Information

AirSeed will destroy or de-identify your personal information as soon as practicable once it is no longer needed for the purpose for our business operations. Your personal information will continue to be protected in accordance with this Policy. If we destroy personal information, we will do so by taking reasonable steps and using up-to-date techniques and processes.

Security of Information

AirSeed will take reasonable steps to protect your personally identifiable information as you transmit your information from your computer to our website and to protect such information from loss, misuse, and unauthorised access, use, modification, disclosure, alteration, or destruction.

However, you should keep in mind that the transmission of information over the Internet is not completely secure or error-free. Specifically, e-mail sent to or from this website may not be secure, and you should therefore take special care in deciding what information you send to us via email.

Miscellaneous

In this policy "personal information" has the same meaning as under the Privacy Act. We may change this policy from time to time. Although we intend to observe this Privacy Policy at all times, it is not legally binding on AirSeed in anyway. From time to time we may regard it as necessary or desirable to act outside the policy.
